D.A. delayed action on substitute teacher who fled to Mexico

The Los Angeles County district attorney's office chose not to seek the extradition of a substitute teacher wanted for sex crimes, even after prosecutors learned of his whereabouts in Mexico, court records show.

The records contradict statements made this week by a deputy district attorney, who said the teacher would be extradited as soon as authorities could locate him.

The teacher, George Hernandez, was arrested by Huntington Park police in September 2010 for allegedly exposing himself to a girl outside a middle school. Detectives who searched his Inglewood apartment discovered a videotape they say shows Hernandez molesting a second-grader in a classroom. He was released on bail and fled the country.

An investigator working for a bail bonds company found Hernandez early last year, and Jalisco, Mexico, state police briefly detained him on Jan. 19, 2011. In a letter faxed nine days later, the company informed the district attorney that it was continuing to track Hernandez and could help apprehend him.

But on March 15, Deputy Dist. Atty. Ann Huntsman responded saying prosecutors did not want to bring him back to Los Angeles.

"We have evaluated the case and have determined that we will not seek the defendant's international extradition from Mexico on this case at this time," Huntsman wrote. "The case will remain open and the defendant is still subject to prosecution in this case."

The revelation comes in a case that has focused attention on how schools can fail to weed out dangerous teachers. Before his arrest, Hernandez had been investigated three times at three L.A. Unified School District elementary schools for alleged sexual misconduct. He was never charged and apparently never reported to the state commission on teacher credentialing.

Sandi Gibbons, a spokeswoman for the district attorney, said the decision came after consultation with U.S. Justice Department officials, who said success was far from guaranteed.

Prosecutors also considered the fact that Hernandez, now 45, had no criminal record and that the charges they had filed against him ? possession of child pornography and indecent exposure ? fell short of child molestation, Gibbons said.

Huntington Park police, who investigated the case, said they showed prosecutors several videos they found in Hernandez's apartment. Some had been downloaded from the Internet. Others appeared to be homemade, including a 14-minute video in which Hernandez appears alone with a girl detectives said they eventually identified as a 7-year-old student.

Detectives determined that the video was made in 2008 in a classroom at Beulah Payne Elementary, in the Inglewood Unified School District, while Hernandez was filling in for a teacher on leave. According to their investigative report, he repeatedly reached under the girl's clothes and placed her across his lap, as she tried to resist.

Gibbons said prosecutors determined the strongest charge the evidence could support was felony possession of child pornography. The charge was based only on a video taken from the Internet, she said. Prosecutors were never shown the evidence related to the video of the child in the classroom, Gibbons said.

"We presented what we had and they didn't feel that was enough for more serious charges," Huntington Park Lt. Anthony Porter said Friday.

Inglewood schools hired Hernandez in 2007 after he had left L.A. Unified under a cloud of suspicion. His 2010 arrest ? and his flight soon after ? received little public attention at the time. But if Hernandez remained a fugitive, Aladdin Bail Bonds stood to lose his $30,000 bail.

The company hired a Mexican investigator, Antonio Oswaldo Ramirez Perez; and in January 2011, he went to San Miguel el Alto, where Hernandez had spent his early childhood before moving to the United States. It wasn't hard to find him.

"It's a very small town," Ramirez said by phone this week. "He was well known."

Hernandez drove a red Ford pickup with Jalisco license plates. He was living in the center of town in a small house that Ramirez thought belonged to Hernandez's relatives and he didn't have a job.

With help from the Jalisco state police, Ramirez photographed Hernandez holding a Mexican newspaper, collected his fingerprints and copied down his driver's license number.

The information was included in the bail company's Jan. 28, 2011, letter to the L.A. County district attorney. "Aladdin's investigators remain aware of the defendant's whereabouts and can assist in the apprehension of the defendant if Los Angeles County law enforcement authorities wish to commence extradition efforts of the defendant in this case," it said.

It was filed in court, along with the response from the district attorney.

Under California law, a bail company can keep its money if it locates a fugitive abroad and provides the information to prosecutors. On April 5, a judge ruled that Aladdin was off the hook.

After The Times published an article about Hernandez's case this week, L.A. County Deputy Dist. Atty. Diana Martinez said he would be extradited as soon as his exact location could be determined.

There has been no such effort "because that requires we know where he is," she said in an interview Wednesday.

Gibbons said Martinez was not aware Hernandez had been located or of the discussions about his possible extradition. The case remains open, she added.

Meanwhile, Hernandez's family has been begging him to return, according to a relative, who said, "All of his actions have shown what a coward he is, and I doubt he will come back."

Writing and Speaking in a Distinctive Voice

Speaking in a distinctive voice has little to do with using big or complex words (though I must admit Im often amazed by how otherwise educated people have developed such a limited a vocabulary).

A distinctive voice is more simplicity than flamboyance. The simpler the words and sentence construction the more transfixed recipients are likely to be.

Simplicity is always more powerful than complexity. Profound truths come in simple phrasings that cut to the bare bones of the thought or situation. Complexity is over-packaged language that leaves us feeling off balance and wondering if our interpretation is pure and accurate.

But lets get back to basics. I said last week that our voices lack distinction because we all walk around parroting one another, all using the same old clichs, making our voices indistinguishable from the vast choir of people saying the exact same things.

So we blend in rather than stand out.

That can change by ridding our language of all those echoes. Here are some examples of common clichs, followed by the same information expressed in a distinctive way.

Clich: Think outside the box. (Irony: Using clichs isnt thinking outside the box.)

Revision: Come up with original ideas.

Its a no brainer.

It couldnt be any more obvious if you handed it to me on the end of a skewer.

This isnt rocket science. (Irony: Rocket science isnt actually all that complicated.)

This isnt particle physics.

This is a win-win situation.

Both sides benefit from this deal.

We need to focus on core competencies.

We need to stick with what we do best.

The proposal is cost prohibitive.

The proposal is too expensive.

We need to hit the ground running.

We need to move fast.

I dont have the bandwidth.

I dont have time.

The 800-pound gorilla.

The big problem.

Improve ROI (return on investment).

Improve our financial performance.

Our mission is to assist the economically disadvantaged.

Our mission is to help the poor.

Which of these two managers do you think the CEO will consider direct and clear thinking?

Manager one: The current spending plan is unsustainable.

Manager two: Were going to run out of money.

The first manager sugar coats and minimizes the situation. The second gives the chief executive the bleak and direct truth about the companys situation. Who do you think the CEO is more likely to respect, remember and promote?

Lets take a real-life historic situation. In 1986 the Space Shuttle Challenger exploded during takeoff killing all astronauts aboard. At the White House two senior staffers Chief of Staff Donald Regan and Communications Director Patrick Buchanan walked into the Oval Office to notify President Reagan.

Regan spoke first saying, Mr. President, theres been a tragedy.

Buchanan, a no-nonsense straight talker, immediately added, Sir, the Space Shuttle blew up.

Reagan leapt to his feet after hearing Buchanan speak.

What Donald Regan said wasnt a clich or common phrase but it was too general to make an impact commensurate with the situation.

It was Buchanan who evoked the appropriate emotional response from the President by telling him what happened in simple, specific, brief language.

Donald Regan blew smoke. Patrick Buchanan lit a fire. No surprise that Buchanan, not Regan, was the White House communications director.

Simply rewording clichs and speaking more directly is just a first-level effort in the campaign to develop a voice distinctive enough to turn you into an oak among willows. We havent even touched on tone, color, metaphors, similes, storytelling, and so on.

Still, this first-level effort alone can make you a remarkably refreshing speaker and writer, one who sounds more like the office soloist than a choir boy or girl.

Female sex hormones can weaken the ability of fish to protect themselves against environmental toxins

ScienceDaily (Feb. 24, 2012) ? It is well known that female sex hormones (estrogens) that end up in rivers and lakes, primarily via spillage from sewers and livestock farming, pose a threat to the environment. Some environmental toxins can also have the same impact as estrogens. One example of such substances are degradation products (metabolites) from the pollutant PCB. Marte Braathen's doctoral research project has developed methods for monitoring biological responses (biomarkers) in fish to pollution resulting from toxins present in African rivers and lakes.

Environmental toxins having a similar effect to estrogens can lead to hormone imbalance in animals exposed to them. In addition to imitating the effect of hormones, it has also been shown that estrogens and PCB metabolites lower organisms' resistance to other kinds of contaminants.

When developing methods for monitoring biological responses (biomarkers) to pollution in rivers and lakes in Africa, Marte Braathen studied the African sharptooth catfish and also cells from the liver of Atlantic salmon. The research was carried out in South Africa, Tanzania and Norway. Since toxins often end up in rivers and lakes, fish are fitting objects of study when it comes to environmental monitoring.

Whereas chemical analyses look for specific substances, biomarkers will uncover biological effects resulting from substances in the environment, which in turn can involve groups of substances with specific characteristics. Biomarkers can also be cheaper and less dependent on specialised personnel or facilities than traditional, chemical analyses. For these reasons, biomarkers are suitable for use in developing countries.

The methods that were developed using African sharptooth catfish were then tested on fish living wild in four different fresh-water systems in the vicinity of Morogoro, Tanzania. One of these is Mindu dam, which functions as a source of drinking water and as a fishing site for the local population. The other three fresh-water systems are part of sewer drainage systems, which are a natural habitat for the African sharptooth catfish.

Marte Braathen's research shows that the African sharptooth catfish is a species that is suited to the environmental monitoring of fresh-water systems in Africa. The biomarker responses she found were relatively unequivocal and corresponded with responses found in other species of fish. Her study of wild fish demonstrated that the biomarkers, which were developed and validated, were appropriate for detecting contaminated sites in Africa.

Medicare expenses growing faster for obese seniors: study (Reuters)

NEW YORK (Reuters Health) ? Medicare is spending more money every year per person, and each obese beneficiary tacks on an extra $149 a year to that increase, according to a new study.

The researchers say chronic conditions associated with obesity, such as high blood pressure and diabetes, are to blame for the steeper climb in health care expenses.

"Not only do we have more obese Americans, but the obese population appears to be in worse health today than they were in the past," said Dawn Alley, the lead author of the study and a professor at the University of Maryland School of Medicine.

Alley and her colleagues collected survey data on nearly 30,000 people with Medicare, the government's health insurance for seniors. They divided the people into three groups -- normal, overweight and obese -- depending on their body mass index, or BMI, a measure of weight in relation to height.

Between 1997 and 2006, the percentage of obese people rose from 21 percent to 29 percent of Medicare beneficiaries, the researchers found.

Expenses also grew, with the health care tab for a normal-weight person increasing by $122 annually.

For those who were overweight, the cost went up by $230 per person, and for obese beneficiaries it climbed by $271.

"I think that's a perfectly reasonable finding," said Darius Lakdawalla, a health policy researcher at the University of Southern California, who was not involved in the study. "It's in general agreement with a lot of other research on health and disability throughout the population."

When the researchers took into account whether people had chronic conditions commonly linked to obesity, such as sleep apnea, heart disease and diabetes, they found that BMI no longer changed the price tag.

That means the chronic ailments that come with obesity are driving up U.S. health care costs, Alley and her colleagues say.

"Generally, the verdict is obesity and overweight will increase Medicare expenditures. The debate right now is how much it will increase Medicare expenditures," said Zhou Yang, a professor at Emory University, who wasn't part of the new research.

Yang said her approach to measuring the increase among obese beneficiaries would probably yield an even higher estimate than Alley's.

A study from 2009 estimated that obesity-related diseases account for one out of every 10 dollars spent on health care -- or about $147 million total (see Reuters Health story of July 27, 2009).

Alley's group didn't make predictions about how much obesity-related expenses will cost tax payers in the coming years. She said her findings are concerning regarding future expenses, but don't mean the spending is inappropriate.

"In some cases costs are increasing because we're actually doing a better job of treating conditions," she told Reuters Health.

But public health efforts should focus on trying to prevent obesity in the first place, Alley said.
